Today, the U.S. federal government criminalizes and targets immigrants. Too, individuals and non-governmental groups do what they can to support and protect immigrants. History reminds us that a tension has long existed between people of faith who love the stranger and governments that fear the stranger. Further, in the U.S., there are laws that have been used to prosecute people for supporting immigrants, while at the same time there are laws that have been used to shield people who support immigrants from prosecution when their actions are motivated by religion or faith. This course explores the tension between religious freedom and immigration law. We begin with an overview of this tension in society and in the legal arena broadly, and then narrow our scope to look more closely at a case study from southern Arizona. In 2019 the federal government used the so called harboring law and other laws to prosecute volunteers from the group No More Deaths, a humanitarian organization that provides aid to undocumented people in the U.S.-Mexico borderland. Moving between overview and case study, our intention in the course will be to come up with practical lessons learned that might inform how we do the work of supporting immigrants broadly. We will also use the course material as a springboard for discussing the challenges and opportunities we face in supporting those who may be undocumented in the current political moment.

Scott Warren lives in Ajo, Arizona. He has a PhD in Geography, and he is a cultural geographer by training. His research and teaching both explore the impacts of resource extraction, land tenure, immigration, and militarization at the Mexico-U.S. border. He is also a volunteer with border humanitarian groups, and in 2018-2019 he faced trial on felony and misdemeanor crimes related to the provision of humanitarian aid. His experience as a defendant facing these charges is the topic of an ongoing speaking series and book project.\n
